A Santa Barbara man who stabbed an acquaintance on July 4, 2012, was sentenced last week and is now out of custody.

Malik Ellis, according to police, got into a confrontation with a man who “was intent on fighting,” and the altercation ended with Ellis retrieving a kitchen knife and stabbing the man. Police said Ellis dodged the man's punches and even ran away from the fight, only to be followed by the victim. Ellis eventually went to get the knife, stabbed the man after dodging another punch, and fled.

Ellis, according to Deputy District Attorney Anthony Davis, pleaded to assault with a deadly weapon with great bodily injury, and according to a plea agreement received a prison sentence that was suspended in favor of three years of probation and 365 days in jail, though he had credit for more days than that at sentencing.

If Ellis violates probation, he will receive six years in state prison. He also must take anger management classes, have no contact with the victim, and pay restitution.
